By using our services or applying to work with Wiss, you agree to the following terms. We reserve the right to update these terms at any time. Continued use of our services implies acceptance of any changes.
1. Services Provided
We provide management, strategy, marketing, and support services for creators with subscription-based fan pages. The range of services used will be tailored to each creator’s needs.
2. Commission Structure
Our commission ranges from 30% to 45%, depending on the selected services and content type. Details will be discussed and agreed upon before onboarding.
Payouts are typically settled on a [monthly] basis, and details will be clearly communicated before onboarding. Platform fees, chargebacks, or third-party deductions remain the responsibility of the creator.
3. Creator Rights
Creators retain full ownership of their content. Creative control remains with the creator, though we offer guidance to maximize results. Your privacy and boundaries are always respected.
4. Contract Terms
All contracts have a minimum commitment of three (3) months. After this period, the agreement may be canceled by either party with [14] days’ notice, without any additional fees or penalties..
5. Confidentiality
We treat all creator information, content, and income details with strict confidentiality. We expect the same level of discretion in return.
6. Platform Compliance
All content must comply with the terms and policies of the platforms you use (e.g., OnlyFans, Fansly) as well as applicable laws. While we provide support and advice, creators are ultimately responsible for ensuring compliance. We are not liable for account suspensions or penalties resulting from violations.
7. Termination of Services
We reserve the right to discontinue services in cases of policy violations, non-cooperation, or breach of agreement. Similarly, creators may exit the partnership after the initial term.
8. Performance Expectations
While we strive to help each creator succeed, we do not guarantee specific income levels, follower counts, or results. Success depends on multiple factors including platform algorithms, content consistency, and creator engagement.
9. Intellectual Property of the Agency
Any strategies, content templates, or marketing materials we provide remain the intellectual property of Wiss unless explicitly transferred in writing. These resources are for your personal use only and may not be shared, resold, or repurposed without permission.
10. Use of Testimonials or Case Studies
With prior consent, we may showcase anonymized or credited testimonials, success stories, or performance data for promotional purposes.
11. Data Usage & Analytics
We may collect performance data and analytics to optimize strategies and improve results. Any such data will be handled securely and used solely for internal or strategic purposes.
12. Age Confirmation
By using our services or submitting an application, you confirm that you are 18 years of age or older. We strictly work only with individuals who are legally adults and eligible to create and distribute content on fan-based subscription platforms. We do not work with anyone under 18 under any circumstances.
13. Tax Responsibility
Creators are solely responsible for reporting and paying any applicable taxes on income earned through their content and activities. Wiss does not withhold taxes and assumes no responsibility for the creator’s tax obligations or legal compliance in their country of residence.
14. Force Majeure
Wiss shall not be held liable for any delay or failure in performance resulting from events beyond our reasonable control, including but not limited to platform outages, internet disruptions, legal or regulatory changes, natural disasters, strikes, or other unforeseen circumstances.
15. Account Access & Security
In cases where we are granted access to a creator's platform account(s), we treat all login credentials and sensitive information with the highest level of confidentiality and security. Access will be used solely for agreed-upon management purposes, and credentials are stored securely. Creators may revoke access at any time, and we will cease use immediately upon termination of the partnership.
16. Acceptance of Terms
By applying to or working with Wiss, you acknowledge that you have read, understood, and agreed to these Terms of Service.
